The firm had been cited for a similar, prior violation and had previous knowledge of the regulatory requirements. The firm directed its workers to enter into the excavation, knowing that the worksite was in violation of regulatory requirements. Firm representatives stated that the reason for taking such actions was because the work's anticipated duration was "short term" and in this case expected to take two days. The firm has a history of high-risk violations, committed willfully or with reckless disregard.
