Penalties - Construction


Penalties are fines for health and safety violations of the Workers Compensation Act and/or the Occupational Health and Safety Regulation. For information on when penalties are considered and how the amount of the penalty is calculated, see the FAQs.

The address given is the location where the violation occurred and is not necessarily the address of the penalized business. The registered business name is given as well as any "doing business as" (DBA) name.

The delay between the date of the penalty and publication of the penalty by WorkSafeBC is partially a result of allowing time for employers and other interested parties to respond to the initial penalty and for the appeal process.

Company: Bob Mitchell Excavating Ltd., Corner of Coal Creek Road and Pine Avenue, Fernie
Classification unit: Land clearing, excavation, or site surface preparation
Amount: $6,608
Date of penalty: December 21, 2005
Two workers were observed working in an excavation approximately 2.5 m (8 ft.) in depth. The side walls and one end wall were not sloped to a safe angle and were not shored to prevent collapse of the soil, which was a mixture of sandy loam and large- to medium-sized boulders.


Company: Seatech Construction Ltd., 4380 Terminal Place, Campbell River
Classification unit: Industrial, commercial, institutional, or highrise residential construction

Date of penalty: December 20, 2005
A forklift lost its brakes and as a result the operator overturned the forklift and was seriously injured. The employer did not ensure that the forklift was maintained in accordance with the manufacturer's recommendations. The brakes were not adequately maintained and the seatbelt was missing from the forklift. In addition, the operator had not been adequately trained in the safe operation of the forklift. This was a high-risk violation.

Workers were observed working at elevations greater than 3 m (10 ft.) above grade or floor level and were not protected from serious injury through falling by any acceptable means.

The firm, acting as the prime contractor, who was responsible for site safety, knowingly permitted workers to work in unsafe proximity to (less than 3 m or 10 ft. from) an energized conductor where the voltage was 14.4 kV to 25 kV to ground. This was a high-risk violation.

A worker was observed not wearing or using a fall protection system where there was a risk of serious injury from falling. The worker was approximately 6 m (20 ft.) above grade. The penalty was imposed for high-risk and repeat violations. The firm had previously received orders regarding fall protection and failing to ensure workers are adequately informed, instructed, trained, and supervised regarding the requirements for using fall protection.

Several workers, including the president of the firm, were observed installing a cedar shake roof at a height greater than 3 m (10 ft.) without using a fall protection system.

Failure to prohibit workers' entry into an excavation more than 1.2 m (4 ft.) deep before ensuring that the excavation sides were sloped or supported according to the angles specified in the Occupational Health and Safety Regulation, or as specified by a professional engineer. The employer also failed to provide workers with adequate information, instruction, training, and supervision to ensure their health and safety in carrying out their work.

High-risk violations of fall protection regulations in circumstances involving worker on the sloped roof of building (estimated to be 5/12 pitch) in excess of 3 m (10 ft.) above grade.

The firm, on more than one occasion, had violated the Regulation concerning the safe use and erection of scaffolding, and in doing so failed to ensure the health and safety of its workers.

A worker was observed on a makeshift scaffold 3.75 m (12 ft. 4 in.) above a concrete driveway. This was a repeat fall protection violation.

One worker was working at 3.5 m (12 ft.) above grade and another worker was working at 5.5 m (18 ft.) above grade. Neither was using fall protection and neither was aware of the fall protection requirements. The penalty was imposed for high-risk and repeat violations. The firm had previously received orders regarding fall protection and failing to ensure workers are adequately informed, instructed, trained, and supervised regarding the requirements for using fall protection.

Date of penalty: September 26, 2005
Two bricklayers were working on a metal frame scaffold more than 6 m (20 ft.) above the ground without the use of guardrails or other fall protection systems. In addition, an unattended forklift with an extended boom was being used to provide mortar to the workers. The forklift boom was within the limits of approach of high-voltage electrical conductors.
